Terms and conditions of use
1. Subject
These terms govern the sale of the digital PrestaShop modules offered on this site by Cavallini Luca (VAT IT02438610392, Ravenna, Italy). A purchase grants a usage license for the module, not the transfer of the source code.
2. Usage license
- The license allows use of the module on a single shop/domain of the customer, unless otherwise stated on the product page.
- The license is perpetual and includes 12 months of module updates, with renewal optional afterwards.
- Reselling, redistributing or sharing the code with third parties is prohibited.
3. Digital delivery
Modules are digital goods: after payment confirmation they are available for download in the customer account, under My licenses, where you also link the domain of the shop you install the module on. No shipping costs apply. See the Digital delivery page for details.
4. Prices
Prices are shown in euro and are final prices: no VAT is added, because transactions are not subject to VAT under art. 1, paragraphs 54-89, of Italian Law 190/2014.
5. Payment
Payment is made securely by credit/debit card and PayPal, handled by PrestaShop Checkout (powered by PayPal). Card details are processed directly by the payment provider and never pass through or get stored on our servers. Download access is enabled automatically once payment is confirmed.
6. Right of withdrawal
If you buy as a consumer, you have the right to withdraw from the contract, without giving any reason, within 14 days of the conclusion of the contract. To exercise it you can use the Withdraw from the contract here function, available at the bottom of every page and in your account, or send an unequivocal statement to shop@presta365.com, also using the model form below. We will refund all payments received without undue delay and in any event within 14 days of the day we receive your withdrawal notice, using the same means of payment you used.
For digital content the right of withdrawal is lost once the download has started, but only if you first gave your express consent to immediate performance of the contract, acknowledged that you thereby lose your right of withdrawal, and we sent you a confirmation on a durable medium (Art. 59(1)(o) of the Italian Consumer Code; Art. 16(m) of Dir. 2011/83/EU). If any one of these conditions is missing, the right of withdrawal remains valid for 14 days.
Model withdrawal form (complete and return this form only if you wish to withdraw from the contract). To: Cavallini Luca, Via Madonna 10, 48123 Ravenna (RA), Italy, shop@presta365.com. I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract of sale of the following goods (*)/for the provision of the following service (*): ... Ordered on (*)/received on (*): ... Name of consumer(s): ... Address of consumer(s): ... Signature of consumer(s) (only if this form is notified on paper). Date. (*) Delete as appropriate.
6 bis. Refund guarantee
In addition to the rights granted by law, the seller offers a voluntary guarantee: if within 15 days of the purchase the module does not do what its product page describes, the customer can write to shop@presta365.com and receives a refund of the amount paid, through the same means used for the payment. The request must state the order and describe the problem; the seller may ask to verify it before refunding. The guarantee covers the declared behaviour of the module, not its adaptation to third-party themes or modules.
7. Warranty and support
Modules are maintained and updated directly by Presta365. Support is provided by email at shop@presta365.com for installation, configuration and troubleshooting. A live demo is available at demo.presta365.com to evaluate the modules before purchase.
Legal guarantee of conformity. If you buy as a consumer, the seller is liable for any lack of conformity of the digital content under Articles 135-octies et seq. of the Italian Consumer Code (introduced by Legislative Decree 173/2021), for defects that become apparent within two years of supply. The legal guarantee is free of charge, is in addition to the refund guarantee in section 6 bis and is not limited by the duration of the included updates or by any other clause of these terms.
8. Limitation of liability
The seller undertakes to provide working modules and to fix any defects. The customer is responsible for backing up their shop before installation and for verifying compatibility with their PrestaShop version and any third-party customisations. The seller's liability is in any case limited, to the extent permitted by law, to the amount paid for the module.
9. Governing law and jurisdiction
This relationship is governed by Italian law. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the country where you habitually reside (Art. 6 of Regulation (EC) 593/2008). The Court of Ravenna (Italy) shall have jurisdiction over disputes, without prejudice to the mandatory consumer-protection venues.
